ORDER
WHEREAS on November 5, 2004 the Ontario Securities Commission (the "Commission") issued a Notice of Hearing and Statement of Allegations pursuant to section 127 of the Securities Act, R.S.O., c.S.5, as amended, in respect of the respondents : Joseph Edward Allen, Abel da Silva, Chateram Ramdhani and Syed Kabir.
AND WHEREAS , since November 5, 2004, several attempts have been made by Staff of the Commission to effect service of Syed Kabir at 180 Cameron Avenue in Toronto, as described in the Affidavit of Service of Frank Giorgio sworn November 20, 2004.
IT IS ORDERED THAT :
Syed Kabir has been effectively served with the Notice of Hearing and Statement of Allegations, pursuant to Rule 1.3(3) of the Rules of Practice, and has been provided with reasonable notice of this proceeding before the Commission.
Syed Kabir shall, until the conclusion this proceeding, keep current his address, telephone number and fax number, pursuant to Rule 1.4(2) of the Rules of Practice, by notifying the Commission of any changes by faxing the Secretary of the Commission, Mr. John Stevenson at 416-593-2318.
Until Syed Kabir advises the Commission of an address change, parties to this proceeding may continue to serve or deliver documents to Syed Kabir's last known address of 180 Cameron Avenue, Toronto, M6M 1R7
- A pre-hearing conference, pursuant to Rule 2 of the Rules of Practice, shall be held on Thursday, January 13, 2005 at 10:00 a.m. at offices of the Commission on the 17th floor of 120 Queen St. West in Toronto .
- Prior to the Pre-Hearing Conference, each party may file written submissions by no later than Thursday, January 6, 2004.
- This Order, along with a copy of the affidavit of Frank Giorgio, shall be served on Syed Kabir by delivering a copy of this Order and the affidavit, and by mailing a copy of this Order and affidavit, to 180 Cameron Avenue in Toronto. Service in this manner is effective on the 5th day after the document is mailed.
