ORDER

WHEREAS on August 13, 2020, the Ontario Securities Commission held a hearing by video conference, at the request of the parties;

ON HEARING the oral submissions of the representatives for Staff of the Commission, Global Bioenergy Resources Inc., Nayeem Alli, Maurice Aziz, Harish Bajaj and Andre Itwaru, no one appearing for First Global Data Ltd.;

IT IS ORDERED THAT:

  1. Any motion regarding the schedule or mode of the merits hearing shall be heard on September 2, 2020, at 10:00 a.m., by video conference, or on such other date or time as may be agreed to by the parties and set by the Office of the Secretary.  The motion materials shall be served and filed according to the following deadlines:
     
    1. moving parties’ motion records and written submissions by August 24, 2020; and
    2. responding affidavits, if any, and written submissions by August 31, 2020;
  2. By August 19, 2020:
     
    1. Staff shall serve the respondents with a hearing brief containing copies of the documents, and identifying the other things, that Staff intends to produce or enter as evidence at the merits hearing; and
    2. each respondent shall serve every other party with any documents, and identify any other things, that have not previously been produced to Staff and that the respondent intends to produce or enter as evidence at the merits hearing;
  3. By August 26, 2020, each respondent shall serve every other party with:
     
    1. a hearing brief containing copies of the documents, and identifying the other things, that are not already contained in Staff’s hearing brief and that the respondent intends to produce or enter as evidence at the merits hearing; and
    2. a list of the documents or things contained in Staff’s hearing brief that the respondent intends to produce or enter as evidence at the merits hearing.
