OSC seeks applications for Mediation Program

TORONTO – The Ontario Securities Commission (OSC) is seeking applications from qualified mediators interested in serving on the Enforcement Branch’s Mediation Program (the program) roster. As independent and neutral third parties, mediators help parties reach agreement on issues arising from enforcement proceedings, such as an agreed statement of facts.

The OSC intends to select up to five mediators to serve a three-year term on the program’s roster. The OSC is looking for individuals who have general knowledge of securities law and capital markets; securities regulatory enforcement experience as litigation counsel, adjudicator, mediator or judge; and mediation experience generally.

Mediators must be free of conflicts of interest, both direct and indirect, at the time of the mediation. That is, they may not represent parties to OSC investigations and proceedings, may not be retained on other matters by the OSC, and may not be associated as an employee, partner or ‘as counsel’ with a law firm or other entity that has dealings with the OSC, either directly or indirectly.

The mandate of the OSC is to provide protection to investors from unfair, improper or fraudulent practices, to foster fair, efficient and competitive capital markets and confidence in the capital markets, to foster capital formation, and to contribute to the stability of the financial system and the reduction of systemic risk.
